Open Internet Statement

The Federal Communications Commission issued rules to preserve the internet as an open platform that went into effect on November 20, 2011. SUMMARY: All Internet Service Providers are required to post information regarding various issues so that consumers, both residential and business, can make informed choices about choosing an Internet Service Provider.
The FCC’s rules focus on four primary issues:

1. Transparency: Fixed and mobile broadband providers must disclose the network management practices, performance characteristics, and terms and conditions of their broadband services.
2. No blocking: Fixed broadband providers may not block lawful content, applications, services, or non-harmful devices.
3. No unreasonable discrimination: Fixed broadband providers may not unreasonably discriminate in transmitting lawful network traffic.
4. Reasonable network management: ISPs may engage in reasonable network management to maintain a high quality of service for broadband internet access.

In compliance with FCC rules and regulations, this webpage contains Velocity Broadband Internet policies regarding our Fixed Wireless Broadband services. The open internet policies contained herein serve as a supplement to Velocity Broadband Internet’s existing terms of service.

Performance/Usage Policy

Velocity Broadband Internet does not impose a data cap on Internet Connectivity.
Velocity Broadband Internet considers 5 p.m. – 12 a.m. the peak network usage period during the week and weekends.

Modem/Gateway Policy
A customer may provide and may install their own router to use with Velocity Broadband Internet’s fixed wireless broadband radio. Velocity Broadband Internet will not be responsible for any damages to the router and will not provide troubleshooting service for the router.

Digital Voice Services Impacting Internet Connectivity
Business customers receiving both Velocity Broadband Internet’s Internet Connectivity and Digital Voice services may experience performance issues from time to time unless a Quality of Service (QoS) router is set up. A QoS router shapes the Internet traffic giving priority to specific types of traffic such as voice, video, etc. Velocity Broadband Internet gives top priority to voice.
Velocity Broadband Internet recommends QoS as part of our Digital Voice service and can install a router that is designed for QoS to prevent performance issues.

Network Management Policy
Velocity Broadband Internet passively monitors network traffic to ensure capacity is sufficient to maintain an efficient network load, to perform diagnostics, and to otherwise manage and enhance the network.
Velocity Broadband Internet does not utilize the following network management practices:
Congestion Management through automatic systems that make changes to network routing or individual customer bandwidth and/or latency based on network congestion
Application-specific monitoring
Subscriber-triggered monitoring
Velocity Broadband Internet does not block any lawful content, applications, services or use of non-harmful devices, or discriminate in transmitting lawful network traffic except when reasonably necessary to manage the network effectively for customers.
All lawful Internet use is handled identically, and Velocity Broadband Internet does not slow, throttle, or shape one type of use over another. Velocity Broadband Internet reserves the right, in accordance with applicable law, to employ reasonable network practices to prevent certain harmful or illegal activity.
Velocity Broadband Internet employs several tools and programs to protect email accounts hosted by Velocity Broadband Internet from the distribution of spam, viruses or other harmful code. However, Velocity Broadband Internet does not control the content passing through its network to end users and strongly recommends that all subscribers and Wireless users protect against malware, viruses or other malicious programs by installing protective software on all end-user devices.
Velocity Broadband Internet’s service is delivered on a “best efforts” basis. Certain circumstances may affect the speed and Quality of Service, including but not limited to foliage, line-of-sight obstructions, and the distance between a customer and the distribution point. Connecting multiple devices within a home may also impact speed and performance.

Network Performance Policy
Velocity Broadband Internet’s network may experience some packet loss because packets are sent over radio frequency airwaves instead of through cable or fiber lines. Also, the network’s latency may be impacted by interference from airwaves outside of Velocity Broadband Internet’s control.
Latency is the amount of time it takes a packet to travel from source to destination. Together, latency and bandwidth define the speed and capacity of a network. Packet loss occurs when one or more packets of data traveling across a computer network fail to reach their destination. Network congestion typically causes packet loss.
