Terms & Conditions

Customer agrees to purchase broadband wireless service from Velocity Broadband Internet, Inc. (WISP), (VBI) for a term of twelve months; If WISP determines that service cannot be provided as stated herein, neither WISP nor Customer will be liable for any order cancellation charges. Installation fees are not refundable, unless there is service failure due to an uncorrectable signal failure in the first 30 days of service. Customer agrees to hold Velocity Broadband Internet, Inc. harmless and release Velocity Broadband Internet, Inc. from liability for acts of God or other events, which result in damage to Customer by presence of the equipment Velocity Broadband Internet, Inc. installs under this contract.

Standard Installation and Monthly Service The installation labor*, parts and equipment necessary for you to receive the wireless signal and transmit it to one computer at your location is $300.00, tax included. Additional services will be billed at $75 per hour including extra work such as repairing your computer or setting up a wireless network at your location.

Speeds available will be determined during site-visit. Early termination or cancellation fee is price per day for internet usage from last payment during any given month. Customers who want to equip a network of computers can either purchase a router from Velocity Broadband Internet, Inc. to be configured with their PPPOE username and password, or can obtain at their own expense hardware and software as may be necessary.

Service Speed: Customer understands and agrees that the speeds listed herein are maximum speeds and that no specific service speed guarantee is made due to varying signal strength. Customer acknowledges that service interruptions may occur from time to time due to maintenance or outages. Outages or impairments may be caused by a variety of circumstances, including, but not limited to, weather, obstruction in the radio path or other interference sources.

If in the future WISP is unable to continue to provide service to Customer for any reason, this contract will be terminated without liability or damages to any party. Customer acknowledges that WISP may terminate service without notice, if the service provided is used, with or without knowledge of Customer, for activities that cause harm to the network or other Internet users. Providing access to this service to third parties is a violation of this agreement. It is expressly forbidden to make this service available outside the area of the physical space that the service is installed in that you do not exclusively control, for example sharing between buildings or among tenants of a building. Sharing your PPPOE user ID and password for the service is a violation of this agreement. Customer is responsible for properly securing all systems connected to the service from outside intruders.

WISP provides its subscribers with access to the Internet only on the terms and conditions set forth herein. Your use of the WISP system services constitutes acceptance of these terms and conditions.
SERVICE AND NOTICE Velocity Broadband Internet, Inc. agrees to provide its Wireless Internet Access Service (Service) to you (Customer) for Customer's private use. All payments and correspondence are to be made to Velocity Broadband Internet, Inc., PO Box 1044, Mena, AR 71953. Use of the Service must conform to the restrictions associated with Customer's account and as set forth herein. VBI reserves the right to terminate the Service if Customer violates such restrictions. WISP reserves the right to immediately terminate service of any Customer who intentionally jeopardizes or attacks the system, uses it to attack or injure others or their systems, for illegal or prohibited purposes.

ONLINE CONTENT: Customer is responsible for any information which it places or accesses on the Internet or which it uses through the Service. Customer is solely responsible for the legality of any such information or the access or use thereof and for choosing to read or view any material it accesses on the Internet. VBI expressly disclaims any and all liability from all claims for damages arising out of, or claimed to arise out of, any such material. The Service may only be used for lawful purposes. Customer is solely responsible for determining the legal status of any intellectual property it uses or duplicates using the Service.
FEES AND BILLING: Customer's billing period begins on the first day of service and is to be paid by check within fifteen days of invoice. If check deposits are declined for lack of funds a $25.00 fee plus bank charges for bounced check will be billed to the Customer and accounts that become 30 days overdue they will be charged interest at the rate of 1.5% per month, and accounts more than 60 days overdue will be suspended. Accounts more than 90 days overdue may be cancelled and sent to collection. Mail and files will not be accessible during suspension periods and may be deleted if the account is cancelled.

DISRUPTION OF SERVICE: WISP assumes no liability for any loss or consequential damage due to disruption of service for any reason, including failure of WISP’s network equipment, or disruption of service or failure of any supporting or upstream provider of service to VBI, including telephone companies, long distance carriers, network, or electrical power providers. In no event will any refund be given for such disruptions. Customer expressly agrees that use of the Service is at customer’s sole risk.
If Customer’s connection ceases to function properly, but WISP network is still functioning properly, a technician will be sent to troubleshoot during normal business hours (9AM-4:30 PM, Monday-Friday). If the problem is on the Customer’s end a service fee of $75.00/hour will apply.

INDEMNIFICATION: Customer is responsible for all actions it takes in connection with its use of the Service. As a condition of the Service, Customer agrees to indemnify and hold harmless WISP, and their respective officers, employees, agents, and shareholders from any claim or cause of action by Customer or any third party for any damages arising out of, or claimed to arise out of, Customer's use of its account, or the use of such account by any person whatsoever, to access the Internet or any information thereon. Additionally, Customer agrees to indemnify and hold harmless WISP and their respective officers, employees, agents and shareholders from any claim or cause of action by Customer or any third party for damages arising out of, or claimed to arise out of the installation of Customer Premise Equipment (CPE) on Customer’s property.

BOUNCED CHECKS: as stated in the Fees and Billing Section. Dishonored checks will be subject to a $25 fee plus collection costs, if applicable. WISP does not redeposit returned checks.

SERVICE CANCELLATION: Customer may cancel its Service at any time by sending written notice via U.S. postal mail or e-mail to VBI. No refunds for purchased equipment will be provided.

MODIFICATION OF AGREEMENT: WISP reserves the right to change the rates, and otherwise modify the terms and conditions of this Agreement by notifying Customer in writing 30 days in advance of the effective date of such proposed changes. If Customer does not request its Service to be terminated, it will be presumed that Customer consents to the modifications to this Agreement. If Customer chooses to cancel service at the time of such notification of modifications to this Agreement, VBI will waive any cancellation fee.
DAMAGES In the event of loss or injury to service, data and/or physical property of any kind under any circumstance, including accidental or intentional act by employees, vendors, agents or others of WISP, or as a result of such actions by others; Customer’s sole remedy is for refund of the Service charges in which the loss or injury occurred.

JURISDICTION AND ATTORNEYS FEES: This agreement is made under and shall be governed by and construed in accordance with the laws of the State of Arkansas. Venue for action lies in the County of Polk. Attorneys’ fees will be awarded to the prevailing party.
